Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the SitList mobile application (the “App”), operated by SitList, Inc (“SitList,” “we,” “us,” or “our”). SitList connects customers seeking babysitting or pet-sitting services (“Clients”) with independent caregivers (“Sitters”).

By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Purpose of SitList

SitList is a marketplace platform that allows Clients to find, communicate with, and book independent babysitters or pet sitters. SitList does not employ Sitters and is not responsible for the acts or omissions of any user.

SitList does not provide childcare or pet-care services directly.

2. Eligibility

To use SitList, you must:

• Be 14 years or older
• Create an account with accurate and truthful information
• Do not use the platform for any unlawful or unsafe activity
• Acknowledge that babysitting and pet-sitting involve inherent risks

Parents or guardians are responsible for ensuring the safety and supervision appropriate to their family’s needs.

3. User Accounts

To access services, you must create an account and agree to:

• Keep your information accurate and up to date
• Maintain the confidentiality of your login credentials
• Be responsible for all actions taken under your account
• Do not impersonate another person or misrepresent your identity

SitList may suspend or terminate accounts for violations, safety risks, or fraudulent activity.

4. Babysitting & Pet-Sitting Bookings

Clients may request services, including but not limited to:

Babysitting:

• Child supervision
• Feeding, bedtime routines
• Age-appropriate activities
• Light household tasks related to childcare

Pet Sitting:

• Feeding, walking, and administering simple pet care
• Supervising animals in the home
• Providing companionship and monitoring behaviour

The exact services provided must be agreed upon between Client and Sitter through the App.

SitList is not responsible for confirming the accuracy of sitter qualifications. Clients must perform their own due diligence.

5. User Responsibilities

5.1 Client Responsibilities

Clients agree to:

• Provide accurate details about children or pets, including medical needs, allergies, behaviour issues, and special instructions
• Ensure their home environment is safe for the Sitter
• Comply with payment terms
• Treat Sitters respectfully and professionally
• Not request illegal, unsafe, or inappropriate tasks

Clients acknowledge that children, pets, and property remain their responsibility, even when a Sitter is present.

5.2 Sitter Responsibilities

Sitters agree to:

• Provide childcare or pet-care services in a responsible, professional manner
• Follow reasonable instructions from the clients
• Prioritize the safety and well-being of children and animals
• Be on time and communicate proactively
• Not engage in any harmful, illegal, or unsafe behaviour

Sitters must comply with all applicable laws regarding childcare and pet care.

6. Payments & Fees

Payments are processed through third-party providers. By booking a service, you authorize SitList or its payment processors to charge your payment method for:

• Booking fees
• Service fees
• Tips (optional)
• Cancellation fees (if applicable)

All fees are disclosed during booking. SitList may modify fees with notice.

7. Communication & Messaging

The App includes messaging features to coordinate bookings.

You agree to:

• Use messages respectfully
• Not send abusive, inappropriate, or harmful content
• Not exchange contact information for the purpose of bypassing the platform (“off-platform booking”)

SitList may monitor or review messages for safety or compliance.

8. Prohibited Conduct

Users may not:

• Leave children or pets in dangerous conditions
• Request or provide medical care beyond basic first aid
• Use the App for harassment, fraud, or illegal activity
• Bring unapproved individuals to a booking
• Leave Sitters alone with aggressive animals
• Violate local childcare or animal welfare laws

Violations may result in account termination or legal action.

9. Safety & Disclaimer

SitList does not certify, license, or guarantee the qualifications of Sitters.

Clients are responsible for evaluating a Sitter’s suitability, including:

• Interviews
• Background checks
• Verification of experience
• Checking reviews

SitList is not responsible for:

• Injury to children, pets, or Sitters
• Accidents, damages, or losses during bookings
• Misconduct or negligence of any user
• Medical issues, allergic reactions, or pet behaviour

Users assume all risks related to childcare and pet-sitting arrangements.

10. Liability Limitations

To the fullest extent permitted by law:

• SitList is not liable for indirect, incidental, or consequential damages
• SitList’s total liability will not exceed the amount you paid for services in the previous 12 months
• SitList is not responsible for cancellations, no-shows, or disputes between users

Some jurisdictions may not allow these limitations.

11. Indemnification

You agree to indemnify, defend, and hold SitList harmless from claims arising out of:

• Your use of the App
• Your interactions with other users
• Personal injuries, property damage, or animal-related incidents
• Violations of these Terms
• Violations of any laws or regulations

12. Cancellation & Refunds

Cancellation policies may vary by booking. Clients may be charged:

• A late cancellation fee
• The full booking price (for last-minute cancellations)

Refunds are issued at SitList’s discretion.

13. Termination

SitList may suspend or terminate accounts for:

• Safety concerns
• Fraudulent activity
• Violations of these Terms
• Harmful or inappropriate behaviour

Users may delete their accounts at any time.

14. Work Authorization

Sitters confirm that they are legally authorized to work in the United States. SitList does not sponsor, manage, verify, or assume responsibility for a sitter’s immigration or work authorization status.

15. App Updates

We may update or improve the App at any time. Features may change, and some may be discontinued without notice.

16. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect and use data.

17. Governing Law

These Terms are governed by the laws of Texas, USA.
